Terms of Service

1. Agreement to these terms
By creating an account or using Miven (“the Platform”), you agree to these Terms of Service. If you are using the Platform on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these terms. If you do not agree, do not use the Platform.
2. What we do
Miven is a platform that lets creators earn money by selling access to their digital content. You share a link to your content—an article, a video, a course, a dataset, or anything else that lives at a URL—and we handle the payment and access gate. Your content stays where it is. We never store, host, or modify your files. We also enable automated access for software agents, so you can monetise your content beyond human readers.
3. Your account
- You must provide accurate and complete information when you register.
- You are responsible for keeping your login credentials secure. You must notify us immediately if you believe your account has been compromised.
- You must be at least 16 years old to use the Platform.
- We may suspend or close your account if you violate these terms or if we reasonably suspect fraudulent or harmful activity.
4. Creators — your content and obligations
- You own your content. Miven claims no ownership over anything you monetise through the Platform.
- By adding content, you grant us a limited, non-exclusive licence to deliver it to users who have paid for access. This licence ends when you remove the content from the Platform.
- You set your own prices. You are responsible for ensuring your pricing complies with applicable laws, including consumer protection and tax regulations.
- You must not monetise content that: is illegal or promotes illegal activity; infringes someone else's intellectual property or privacy rights; contains malware, phishing links, or other harmful code; promotes hate speech, violence, or discrimination.
- We may remove content and suspend accounts that breach these rules, at our sole discretion.
5. Payments and fees
- All prices on the Platform are in US dollars. Payments are settled in digital dollars on a public payment network.
- Miven charges a service fee on each transaction. The current fee rate is displayed in your dashboard. Fees are deducted before earnings are settled to your wallet.
- Payments are final. Once access to content has been granted, a payment cannot be reversed. This is an inherent property of how the payment network operates. If you experience a technical issue that prevents access, contact our support team immediately before attempting another payment.
- Creator earnings are settled automatically after each successful transaction, minus the platform fee. Settlement typically occurs within seconds.
- You are responsible for any taxes that apply to your earnings. Miven does not provide tax advice.
6. Consumers — buying access
- When you pay to unlock content, a secure wallet is created for you automatically. Your payment credentials are handled by a regulated payments provider; we never see or store your private keys or card details.
- You authorise each payment individually. No recurring charges are made without your explicit approval.
- After a successful payment, you receive time-limited access to the purchased content. Access credentials are personal and may not be shared or resold.
- Automated access by software agents is permitted within the limits stated in the documentation available on the Platform.
7. Prohibited conduct
You agree not to:
- Attempt to bypass the Platform's payment or access controls.
- Access content you have not paid for through any technical means.
- Use the Platform for money laundering, sanctions evasion, or any other illegal financial activity.
- Upload or link to content that is illegal, fraudulent, or harmful.
- Reverse engineer, decompile, or attempt to extract the source code of the Platform.
- Interfere with the Platform's operation, including through automated means that exceed reasonable usage limits.
8. Intellectual property
- Creators retain all rights to the content they monetise. Miven does not claim ownership of your work.
- The Platform itself—its name, branding, design, and underlying software—is our intellectual property. You may not copy, modify, or redistribute any part of the Platform without our written permission.
- We respect intellectual property rights. If you believe content on the Platform infringes your rights, contact legal@miven.dev with details of the alleged infringement, and we will investigate promptly.
9. Limitation of liability
To the fullest extent permitted by law:
- The Platform is provided “as is” and “as available,” without warranties of any kind, express or implied.
- We are not liable for losses arising from: interruptions or failures of the public payment network; your failure to keep your account credentials secure; content you choose to monetise or access; changes in the value of digital currency.
- Our total liability for any claim relating to your use of the Platform is limited to the greater of: the fees you paid through the Platform in the twelve months before the claim, or one hundred US dollars.
- We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data, even if we were advised of the possibility.
10. Indemnification
You agree to indemnify and hold harmless Miven and its officers, employees, and agents from any claims, damages, or expenses arising from: your breach of these terms; the content you monetise or access through the Platform; your violation of any law or third-party right.
11. Termination
- You may stop using the Platform and close your account at any time through your dashboard settings or by contacting us.
- We may suspend or terminate your account if you violate these terms. We will notify you of the reason where we are able to do so.
- Upon termination: your monetised content links will stop working; any outstanding funds already settled to your wallet remain yours; you remain responsible for any fees or obligations incurred before termination.
12. Governing law and disputes
These terms are governed by the laws of England and Wales. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of London, England.
Before initiating formal legal action, each party agrees to attempt to resolve the dispute informally by notifying the other party in writing and allowing at least thirty days for a response.
13. Changes to these terms
We may update these terms from time to time. If we make a material change, we will notify you through the Platform or by email at least fourteen days before the change takes effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated terms.
